VIDEO Press Conference Charges Filed Against Vista Sheriff’s Deputies for Assaulting Men During Arrest

San Diego County District Attorney Summer Stephan announced today that criminal charges have been filed against two San Diego County Sheriff’s Deputies for their illegal actions during an arrest in Vista. The deputies were responding to a domestic violence call and were taking two men into custody when the assaults occurred.

The San Diego County Sheriff’s Department conducted an investigation, gathered body-worn camera and other evidence and referred the case for evaluation by the District Attorney’s Office.

The San Diego County District Attorney’s office conducted a thorough review and investigation and determined that criminal charges would be filed commensurate with the deputies’ conduct in this case.

Deputy Nicholas Morgan 27, has been charged with two misdemeanor counts of assault without lawful necessity by an officer and faces up to two years in jail if convicted. Deputy Joshua Nahan, 31, has been charged with one misdemeanor count of assault without lawful necessity by an officer and faces up to one year in jail if convicted.

“Law enforcement officers hold a position of trust in our community and are required to abide by the rules in the exercise of their powers,” DA Summer Stephan said. “The evidence on which the charges are based shows the force used by the two deputies exceeded the legal line, violating that public trust. For justice to thrive, it is important that no one is above the law.”

Both men will be arraigned on Friday, November 30 at 8:00 a.m in Department 14 of the San Diego Superior Court in the North County.
