On January 1, 2019, Senate Bill (SB 946) took effect, requiring all cities to authorize the operation of sidewalk vendors on public sidewalks and sidewalks within City parks. According to the bill sponsor, the legislation is intended to protect entry-level entrepreneurs with limited means to raise capital from criminal harassment. Under SB 946, cities may adopt regulations for sidewalk vendors in accordance with the provisions of the bill directly related to objective health, safety, or welfare concerns. Sidewalk vendors are now authorized to sell food or merchandise from a wheeled pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other non-motorized conveyance, or from one’s person, upon a public sidewalk or other pedestrian path. Examples of sidewalk vendors could include, but are not limited to hot dog vendors, coffee carts, popcorn vendors, newspaper vendors, flower vendors, clothing vendors, etc.
